Benefits for a British child / visa swtiching

Post by leon2019 » Sun Jun 02, 2019 12:07 pm

Hello dear members,

I am a british citizen and my wife is a Ukrainian citizen on a spouse visa. Her extension is due in December 2019.

We recently had a baby boy who is also a British citizen because of me being a British citizen.

I would appreciate if someone could please let us know if I could claim any child related state benifits for my baby boy. Will it affect my wife's visa extension???

Also Please can someone let us know if it's possible for my wife to switch to British Child's mother visa (if there is any such category) from spouse visa??..

Many thanks

Where is the child currently located (in the UK or abroad)?

Why do you want your spouse to switch over to a parent visa?

Thanks for your reply.

Our child is born in the UK and is currently with us in the UK.

Someone just told us that it's easier for my wife to become a british citizen now because our son is also British and on his basis, she will be able to switch to a permanent visa category???... it sounds rubbish to me but i just want to make sure what's the reality please...

thanks again

No. She would be able to naturalise immediatly after acquiring ILR as the spouse of a British citizen.

Being the mother or even an unmarried partner would give no such advantage and she would have to wait for a year after acquiring ILR if she were only the mother of a British citizen without being married to one.

on his basis, she will be able to switch to a permanent visa category
The parental route would only work if she had sole responsibility for the child and would only lead to ILR after 10 years, as against the five year route that she is likely on at the current time, as the spouse of a British citizen.

Most members be able for child benefit which should be in British partner name and also child tax credit which should be in joint name.

Apprently child tax credit doesn't exist anymore. All the benefits have been merged into one category 'universal tax credit'.
