Varying exisiting application from FLR to ILR

Post by paulah » Mon Jun 10, 2019 2:54 pm

I have submitted an application to extend my spouse visa and booked my appointment at a premium support office which is in a couple of weeks. However, I may vary my application and apply for a settlement visa instead since I discovered that I am eligible for that (5 year route), as long as I can pass my Knowledge of Life In the UK test which I am taking later this week. My question is, if I pass the test and change my application to settlement, will I be able to keep my existing appointment at the premium support office or will I need to book a new one?

What is your full UK immigration history that you believe you qualify for ilr based on 5 years?

I got a spouse visa in 2014, extended it in 2016 and now it's due to expire next month... 5 years from the time it was first issued. Not really sure how that is answering my question?

What date did you enter the UK on your spouse visa?

When does your visa expire?
Not really sure how that is answering my question?
Some members think it is simply 5 years residence regardless of visas held and then get a surprise when ilr is refused!! As you have no posting histoey on the forum and provided very limited information on your visa route(s) I was trying to establish the facts in order for members to give the best possible advice .

Ok no problem. I actually entered the uk in March 2014 under a fiancee visa and then switched to a spouse visa after I got married, on 3rd of July 2014. My current spouse visa expires on 3rd of July this year.

Was your spouse visa granted/approved on 3rd July or later? Unclear if 3rd July is the date of marriage or visa date.

If it is visa start date, why did you apply for an extension and not directly for ilr before 3rd July after liuk test?

Are from an English speaking country and exempt or have you got an approved by English test?

the visa was granted on the 3rd of July, sorry for the confusion.
I didn't apply for the ILR directly because I'm stupid. I selected the wrong option, I thought a visa extension would automatically get me a permanent visa after 5 yrs. But then I looked further and found that it was a separate type of application and also required the Life in UK test. So now, I'm scrambling to learn as much as I can from the Life in the UK handbook. I have the test scheduled for Thursday this week. My plan is, if I fail the test, I will just proceed with the extension which I have already submitted the application for and just apply for settlement at a later date. However, if I pass the test, I want to vary my application and change to the settlement one. I hope that makes sense?

I am from the US so exempt from the English Language test.

You would need to complete the set m form and pay again, including a covering letter about varying flr m to set m.

How is the covering letter sent? is this by post or digitally as part of the application?
