Complicated route (T4-T5-T2)... when can I actually apply?

Post by spontaneoush » Thu Jun 13, 2019 3:39 pm

I came to the UK in 2012 under a Tier 4 Student visa
In 2015 I transferred to a Tier 5 Gov Exchange visa with a residence permit issued (24 months)
In 2017 I got a Tier 2 through my current employer.
I never left the UK for more than 1-2 weeks/vacation during these 7 years.

I know I could have easily gone straight from Tier 4 to Tier 2 without RLMT, but everything was done last minute and I didn't have enough time or professional guidance on how to go about this (I was only 21 years old no family etc.) so rushed into a Tier 5 first as I thought it was my only option.

So my question is... when can I officially apply from ILR? I'm hoping from 2015 when I got my Tier 5 (so 2020 ILR), but I assume it's more likely 2017 when I received my Tier 2(so 2022 ILR) :(

ALSO if the latter, would I be able to apply in 2022, or would I have to stay an extra 12 months and apply 2023?

Thank you

Your residence time spent under Tier 4 or Tier 5 does NOT count towards your ILR under Tier 2. You will be eligible only in 2022 considering you qualify and have the min salary requirements. You may also apply under long residence assuming current rules remain unchanged. As the rules are subject to change we cannot tell you what to expect in 2022

Your residence for ILR based on 5 years residence starts from the issue date of your Tier 2 visa. Tier 5 and Tier 4 time does not count for 5 years ILR.

Not sure why you think it is 2023. You simply need 5 years residence on Tier 2 and must meet all the requirements.

Edit : beaten by Zimba

On the GOV website it says you need to live here for 5 years then something about an extra 12 months... which is where I got 2023 from lol

You can hold a tier 2 general for a max period of 6 years.

You need 5 years residence for ILR. You then need to wait 12 months before you can apply for British citizenship.
