Permission to marry

Post by kones99 » Fri Jun 21, 2019 8:57 pm

Good day everyone,

I have a question.
If a Non-Eea national is resident in the UK on a UK spouse visa and their British Citizen spouse has divorced them and a decree absolute has been granted, would the Non-Eea then be permitted to marry an EEA national whilst they are still resident on a UK spouse visa, or would such a situation arouse the suspicion of a registrar/vicar and thus be referred to Home Office for investigation?

Many thanks.

The registry office refers/informs HO when any non EU citizen on a visa gives notice to marry. It is up to HO to decide to extend the notice from 28 days to 70 days if they investigate and/or interview each of you separately.
