Tier 2 ICT to Tier 2 ICT Dependant to General Work Visa

Hi ,

I recently ( April 2018 ) shifted from Tier 2 ICT to Tier 2 ICT Dependant.

Now if my company is ready to sponsor a General visa for me , is there any cool off period ?

Recently last year April or is the date a typo and should be April 2019 "recently"??

Yes you are still subject to the 12 month cooling off period. Simply changing to a dependent visa does not change that. You need to hold the dependent visa for a full 12 month period before you can apply for a Tier 2 General visa from your home country.

The only time the cooling off period does not apply is if you are offered a salary of £159,600pa or more.

Just to get the timeline right

My ICT BRP ended on 1st Jan 2019

I applied for ICT dependant visa in Dec 2018 while i was in UK and it is valid till Feb 2020

Now I am right in saying that the cool off period will end on 1st Jan 2020 ? Also considering that I am currently working in UK on dependant visa is the cool off period legit or should I spend the cool off period only in India ?

It ends 12 months after the date your Dependent visa was issued/granted.

The cooling off period means that you must NOT have been on any of the Tier 2 visa as a main applicant for 12 months. There is no rule that the 12 months must be spent outside of the UK.
