what happens if main applicant get the ILR on long residency base to dependent

Post by notna1989jaat » Mon Jul 22, 2019 4:25 pm

Dear Respected Members,

Could you please give me your valuable advice on the below topic as I am a little bit confuse here due to my personal circumstances.

Recently, I have got my ILR on long residency base. I had a tier 2 general visa but unfortunately, I had lost my job before 3-4 months to apply my long residency application. I have never been working on the payroll due to this situation. Now I am thinking to apply for my partner spouse visa but we are meeting the financial requirements 18600, she is earning only 17300. Please see my questions below.

1. if she is not earning 18600, how we can get the spouse visa done, any alternative route we can use?
2. We are planning to travel very soon to the home country, Can we travel without getting this done on the existing visa (Tier 2 dependent) of her.

your advice would be much appreciated,

Many thanks,
RR,

Yes, FLR FP 10 year partner route (4 x 2.5 year visas).

She should change visas BEFORE travelling out of the UK. She risks being refused re-entry as her visa is technically no longer valid as you got ILR based on long residence and not Tier 2.
Char (CR001 not Casa)
