When is it consider 5 years? (in my case)

Post by Blondie_33 » Mon Aug 12, 2019 12:48 pm

ImageHi all,

I hope you will be able to help me here about something I'm a bit confused.
based on: https://www.gov.uk/settled-status-eu-ci ... d-to-apply
Proof of continuous residence
To be eligible for settled status, you usually need to have lived in the UK, the Channel Islands or the Isle of Man for at least 6 months in any 12 month period for 5 years in a row. You need to provide proof of this when you apply.
I live in the UK since January 2015 which is: 4 years and 7 months. During all this period I worked in permanent jobs since day 1 except 5 months where I was working for my own LTD company and paid SA/company tax. hence I have 5 P60: 2015, 2016, 2017, 2018, 2019

based on the quote above, Can I already apply for settlement in the UK although it's not Full 5 years since there could be a gap of 6 months?

During that gap, if you were working for your LTD in the country and can demonstrate it plus you have papers from that period showing clearly you were in the country, this won't be questioned.

However, I wouldn't recommend applying before the full 5 years. A qualifying period is non negotiable and I have seen cases where applications were refused because the qualifying period was short by a few days. From the legal point of view, they can deny you even for a single day short.

I have read in this forum that some have been granted settled for less than 5 years continuous residence but I won't count on that.

After checked with them, it will take few weeks but can take months as well (up to 6 months)
