Tier-2 Dependant Absences

Post by sabi27 » Thu Aug 15, 2019 10:19 am

Hi all the gurus out there,

Apologies if this is already answered elsewhere. I had looked up but couldn't find any precise post related to my query.

Tier-2 Dependant absences. I understand its 180 days in total in any 12 months of 5 years leading to ILR eligibility. Do 90 consecutive days absences are also counted for Tier-2 Dependants?

I meant can a dependant stay outside country for more than 90 consecutive days? as long as they are not 180 days in total in any 12 months?

Many thanks in advance as always

There is NO absence limit of '90 days' at all. Also NO absence limit for tier 2 dependent visas issued BEFORE 11th January 2018. There is ONLY the 180 days for visas issued AFTER 11th January 2018.

If you really did search and did not find anything, then clearly it is not a rule anywhere in HOs rule book.

Thank you so much CR001.

If I remember it correctly there used to be a rule (not sure still in place or not) for Tier-2 main applicants where if they are absent for 90 consecutive days from country, this breaks the continuity in there 5 years. Was thinking if this is applicable to Tier-2 dependants now following changes on 11th January 2018?

Best regards,

The rule, no longer relevant and not quite how you have stated it, was only applicable to main tier 2 visas holders.
