Australian Tier 2 visa holder

Post by aus1986 » Thu Aug 15, 2019 7:18 pm

Hi everyone,

I've scanned through the first page of this forum to check if there was an active thread on this but there isn't so here is my question! Would be great if someone could help me please..
I have a Masters degree from the university of Sydney, Australia and have the original + copy of my degree. Do I need to apply for an NARIC letter? I read somewhere that having the qualification is not the requirement, the requirement is to have proficiency in English. I didn't have to do an English test before I moved to the UK because I was informed that Australian's are exempt from the requirement. So, do I need to pay for an NARIC letter to go with my degree for my ILR application?? Also, isn't a pass on the Life in the UK test also meant to confirm English language proficiency?

Secondly, I have seen a few people mention something about a P60..? My online application asked for the below things as supporting docs and there is no mention of a P60. Can someone please explain what that requirement is..

If you do not provide these documents, your application may be delayed or refused.
NARIC letter that confirms the qualification meets or exceeds the recognised standard of a Bachelor's or Masters degree or PhD in the UK
The degree certificate to prove the level of English language required
Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies
Declaration signed a to confirm consent for the Home Office to request verification checks
All previous passports, travel documents or national identity cards that you have used to travel to or remain in the UK
              Current Biometric Residence Permit
Evidence of immigration status in the UK
Your most recent payslip and bank or building society statement. These must be dated no earlier than one calendar month before the date of the application. The statement must show the payment, as shown on the payslip. You should not provide any additional payslips or statements, unless you are currently on maternity, paternity, shared parental or adoption leave.
A document from the sponsor who issued the certificate of sponsorship that led to your last permission to stay as a Tier 2 migrant confirming that you are:
•still required for the employment in question for the foreseeable future,
•the nearest applicable SOC code which best describes your employment
                    •your current rate of pay
•confirmation that this is at or above the appropriate rate for the job as stated in the codes of practice for Tier 2 sponsors

Thank you in advance for your help!
                    Cheers

You need to tick NO to the degree and English test question. It is only relevant to the English requirement, which is not applicable to you. HO have no interest in how qualified you are so the question doesn't have anything to do with your job or visa route either.

Thanks for your reply! This is a relief. I have been looking everywhere to try and find a reference to this exception but I can't find it anywhere on the website/ in the terms & conditions etc. Would you know where I could find this..? Thanks for your help.

The part of the form is only relevant to the English requirement. As you are from an exempt country, it doesn't apply to you and you answer no. HO know the rules and know that there is nothing you need to submit regarding your degree or an English test.

Amazing! Thanks so much, will follow your advice.

Would you know about the P60 requirement as it's not mentioned on the list that came up during my online application?

Awesome! So glad I came to this message board.

Can you also please confirm if I need to do a Life in the UK test as well?? I thought I needed to do that ahead of neutralisation.. The checklist doesn't mention it but the application did ask me if I had done it. I am planning to do it but wasn't sure if it is a requirement at this stage?

Thanks so much for your help!

You must do life in the UK test, it is mandatory for everyone over 18 and under 65 and you should have completed this part of the form where it asks the details.

                    Evidence of immigration status

                    Post by aus1986 » Tue Aug 20, 2019 4:09 pm

                    Hi everyone,

Quick question please. The documents checklist for my ILR form is asking for:
                    • Current Biometric Residence Permit for Miss xxxx

Evidence of Miss xxxx's immigration status in the UK
But isn't my Biometric Resident Permit that shows the validity date range evidence of my immigration status?? I'm not sure what other evidence I have for my current Tier 2 visa.

Please can anyone confirm that if I provide my Residence Permit that it will satisfy both requirements listed above.

                    Cheers!
