Help Please

Hello All,

I have been in this United Kingdom for just over 10 years now (infact 10 years 1 month) and want to apply for ILR.I want to apply for my ILR through the 10 year rule. I have a 18 months old son and my husband whom are both BRITISH. I am thinking of applying for the ILR through SET (LR) rule.

I have passed my LIFE IN UK test recently and also still have a year valid left for my
Grade 3, CEFR Level A2.1 English certificate provided my Trinity London Hammersmith SELT Centre. Also I did my Bachelors here in the Uk from the reputed University. My transcripts states that the mode of study was English.

I don't even have a gap of 1 day during my 10 year Stay in Uk as I haven't left the country.

As I was filling in the ILR Application SET (LR) ( I guess this is the right form for me ), I got confused with some of the questions.

In the PERSONAL INFORMATION, section there is a question that is asked

a) Do you have any family in your country of birth, nationality or any other country where you have lived for more than 5 years?

What do I state here, is it my parents who are living back home and their address. My brother lives in Germany, my another sister lives in Kenya so do I have to disclose all of their names and address as well ??

b) Do you have any friends in your country of birth, nationality or any other country where you have lived for more than 5 years?

I have so many friends all over the world, do I have to disclose all their names and nationality ??/

c) Are you part of any social groups or do you have other cultural ties in your country of birth, nationality or any other country where you have lived for more than 5 years?

I am really confused with this question ?



ALL three questions when I type in NO, it states why not and if I type in Yes it ask me for all the details ?/

Also I am confused as which ENGLISH test Certificate is required: A2, B1, B2 as i only have A2 which is only a year old as I needed it last year for my second phase of 5 years extension for 10 year rule.

Also please any one can suggest my what could or may be any other required documents for HOME office.
I am sure my is a straight case so I am hoping that I can apply myself rather that going through the high expensive solicitors. Also that will boast and make me more confident. As a viewers I am just wishing you all the readers who are reading my this blog can help me out with as my answers or questions required. I hope this will also help the future readers.

If you are applying under 10 years long residency, Set (LR) is the right form to use.

with regards to your questions:
a) Answer is Yes, state the names of your parents. if you other close family members doesn't live in the country of your birth, then don't state their names. Don't need to give address as the form doesn't ask for it. Just names, your relation with them and the city they live in is sufficient.
b) Answer is Yes. But don't need to disclose friends from all over the world. Just the ones in your country of birth. Just provide 1 or 2 names. That is sufficient.
c) The answer is no.
Explanation you can give as : I do have cultural ties to XYZ country as it is my country
of birth but as I have been living in the UK for 10 years therefore I am not part of any social groups in my country of birth.

Above were my answers to these three questions and I got ILR just last month.


A2 is not the right English certificate as I believe you need to prove your English language at B1. You should only submit the degree that you gained from the UK and do not submit A2 certificate with application as it may confuse things.

LR is a straight forward application: You'll need the following:

1- All passports
2- BRP card
3- Life in the UK
4- English Language
5- No absence of more than 180 days in one visit
6- No overall absences from the UK of 540 days in 10 years.
7- Some other documents that checklist will ask for at the end of your application form.
and
8- A lot of money if you are going for super priority service i.e. £3,208.20 or 2408.20 if applying as a standard application.

Make sure you calculate your 10 years from the date you entered the UK and NOT the date your first entry clearance was valid from. You can apply 28 days before your 10 years complete. You MUST be eligible on the date of the application and NOT on the date of biometrics appointment. So only pay for the application if you are with in 28 days of your 10 years. So for example, if you entered the UK on 21 Sep 2009 you MUST only apply after 26 Aug (give or take).

No need to use a solicitor. Just make sure you read the guidance. Below are some members' experiences. Read their experiences and you should be fine.
