ILR Application while dependent wife is not eligible

Post by gurkanoluc » Wed Aug 21, 2019 8:18 pm

Hey folks,

I moved to UK in September 2014. This September it's going to be my 5th year and I will be eligible to apply for ILR. ~1.5 years after I moved here, I got married to my wife who used to be back in Turkey before we got married. So we have been married and living in the UK together for almost ~3.5 years. But personally, I have been living in the UK for ~5 years. The gov.uk clearly says that for her to be added as dependent on my ILR, we should be living together for 5+ years. Or is it like she can still be added as a dependent on me, but in case something happens to me or we get divorced she would need to return back?

My question is, given my wife can't be added as dependent to my ILR application, what should I do? The current BRP she has at the moment gives her the right to stay until September 2020, should we do another extension application when that time comes? Or when I apply for ILR is there any way to keep her as my dependent on my ILR?

Thanks,
Gurkan

She doesn't qualify for ilr. She needs 5 years as tier 2 dependent before she can apply (assuming you are a tier 2 visa holder).

She can apply for an extension shortly before her visa expires. It will be a 3 year extension.

Note that there is no visa called "ILR dependent".

Yes, I'm on Tier-2 General.

So, in my ILR application, I will not add her then. You said she will apply for an extension before her visa expires but at the same time, you said there isn't a visa called ILR dependent? So in which category will she apply?
