PLEASE HELP! URGENT

Post by Clair74 » Mon Aug 26, 2019 2:38 pm

Hi all,

My friend is British, just over 2 years ago she got married with an Albanian citizen that happens to be paraplegic. He applied for his visa outside the UK and entered legally to live with her here. They are living together since.
Now is time for him to extend his visa, would he be able to successfully apply under the circumstances I describe below?

- My friend, the British spouse, has a child (the applicant is not the father, but the child lives in their household)
- My friend now only earns £20K per year (nothing else, savings, etc) – 5K less than what she earned when she first applied
- He, the applicant, has never been able to find work, therefore he has no income whatsoever
- Neither the applicant or his wife ever claimed benefit – no benefits!
- They live in a rented council house
- The British spouse receives child maintenance from the child’s biological father (about £110 per month)

I would very much appreciate your honest feedback, and any suggestions on how they can make a successful application.

Do they need £18,600 + £3,800 because the british spouse has a child? It is not the applicant's child and the child's biological father pays for child maintenance.

The child does not need a visa.

If the child is British then will be exempted from financial threshold and your present earning of 20k can meet the financial requirement of £18600.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
