Advice on appealing period for 10 year route ILR

Post by Seekingadvice8 » Mon Sep 02, 2019 5:40 pm

Hello ,

I would like to seek advice from the immigration experts in the forum.

• Arrived in UK on 9th Sept 2009 on Student Visa
• Applied PSW visa on Dec 2010.
• Granted PSW VISA on Feb 2011 till Jan 2013
• Applied Tier 1 Entrepreneur VISA on Jan 2013
• Got Rejection letter in May 2013 due to lack of funds
• Appealed against the home office decision in May 2013
• First Tribunal hearing date in Oct 2013. Won the case
• Home office appealed to Second tribunal.
• Second Tribunal hearing date in Feb 2014
• Won the case and Tier 1 Entrepreneur VISA was granted in July 2014 till July 2017.
• Applied extension of Tier 1 Entrepreneur in June 2017.
• VISA was granted in Feb 2019 till Jan 2021.

My Questions are.

1. I am I eligible to apply for my ILR on 10 years route.
2. My visa application for Tier 1 entrepreneur was rejected in May 2013. I have appealed to first tribunal and won the appeal. From the time of rejection i.e, May 2013 till I was granted my VISA in July 2014. Will this period be considered as legal and continuous stay in UK .

Thanks for your help in advance

R
