Regarding PBS dependant visa with main applicant applying for ILR

Post by priyasha_m » Mon Aug 26, 2019 8:36 pm

Hi,

My husband is due to apply for ILR, and I have to apply for a PBS Dependant extension.

1. How do we connect both applications?

2. We would like to apply at the same time but seems like we can't under his SET(O) application. If I start another application (PBS Dependant - Partner), do I need his application reference number to connect applications?

3. Do we only get his application reference number after he has paid for his SET(O) application? If not, where can I find it?

4. My form asks does the main applicant have ILR. If say no, there is a chance he might actually get his ILR before my application is reviewed, as he is applying with the one day priority service. Will this be a problem?

Thanks a lot! Would appreciate quick answers if possible as we are running on a tight schedule!

PBS extension form will ask about the main applicant’s details you are joining e.g. name, BRP number etc

2. We would like to apply at the same time but seems like we can't under his SET(O) application. If I start another application (PBS Dependant - Partner), do I need his application reference number to connect applications?
No

3. Do we only get his application reference number after he has paid for his SET(O) application? If not, where can I find it?
His BRP number is enough.

4. My form asks does the main applicant have ILR. If say no, there is a chance he might actually get his ILR before my application is reviewed, as he is applying with the one day priority service. Will this be a problem?

Write a cover letter and explain that the main applicant is applying for ILR so hold your application till a decision is made on his application. Your application will be decided after his decision anyways but clarify that in the cover letter

Thanks a lot! Would appreciate quick answers if possible as we are running on a tight schedule!

Thanks for the answer. 1 more question is that I need to provide the main applicant's passport and BRP with my PBS dependant application. How would I do that if both of us get different dates of application, as we have to fill our online forms seperately?

Yes there doesn't seem to be much guidance in the online form. Done filling my husband's ILR form and halfway through my PBS dependant application.

The first question it asks when you filled your own pbs extension form is “person you are joining” isnt it??

Yes but I thought that to mean "Person I am joining in the UK" instead of "Person I am going to the appointment with". I do appreciate your answers but it would be great if you could answer directly instead of answering with questions. I am only asking to clarify.

“Person you are joining” is your husband! i.e. the main applicant. You will fill all his details there. That answers your question how they will connect your form to his. You are the dependent so obviously you are joining him.

I meant appointment not interview. I assume that means that I don't need to provide his passport in the documentation?

Log out and log in again not sure why cant you see it. Once you fill out the online form, at the end, you will get a checklist for the required documents needed. Also, read the relevant guidance for your visa category.

Tier 2 Dependant Question

Post by priyasha_m » Fri Sep 20, 2019 10:08 pm

Hi,

On the PBS and Appendix W Dependant Partners form, in the field, "What is the length of your spouse's Certificate of Sponsorship(CoS)?", I am not sure which of the answers I should choose.

My husband has been with his company for 6 years, the first CoS was for 3 years. The second time, company applied for visas and we are not sure if CoS was renewed or extended. What is more likely?

The 2 options provided are for length of CoS are "more than 3 years" or "less than 3 years".

Please help.

Thanks.

It would have been a new cos for the extension, likely the "up to 3 years"

Can one CoS be valid for 6 years?

Possible but then an initial visa for 6 years would have been issued and a second extension after 3 years would not have been required.

So does a CoS last for the length of a visa?

The visa is issued for the length that is stated in the CoS. So if CoS is for 3 years, it is a 3 year visa. Then a new CoS is needed for X number if years, usually 2 or 3 years, to get an extension.

Thank you, this is very helpful.

One more Q regarding IHS. My husband is applying for ILR at the same time. When I go to IHS payment site for my dependant visa, it asks for the main applicant's current visa expiry. That is next month, so payment is asked for only £200.

What date do I enter so I can pay for 3 years because his ILR has not come yet.

Thanks

Unclear when your visa expires or what service your spouse is using for their ilr.

Might be useful to state this.

There is no requirement that you must apply at the same time he applies for ilr if you still have sufficient visa validity

If you don't pay the required £1200 IHS your application will be delayed.

Both our visas expire on 3rd october. So applying ASAP.

What date do I state for his visa expiry while paying for IHS?

Put a date 3 years, ie 2022, ahead to get the correct IHS.
