Tier 2 ICT Baby born in uk

Post by jadhavabhi » Mon Sep 23, 2019 3:29 pm

Hi,
I am holding Tier2 ICT visa(expiring in Apr 2021) from India. My wife is also holding Tier2 dependent visa and is in UK with me currently. She is expecting a baby in Mar 2020. When she gives birth we would have completed 4 years in UK

1. Can My baby get UK Passport/Citizenship?

What do you suggest where my wife should deliver the baby UK or India?

No. Simply being born in the UK does not make a child British. If a parent gets ILR, then the child can be registered as British on form MN1. But as ICT doesn't lead to ILR, you would have to find another route to stay in the UK.
What do you suggest where my wife should deliver the baby UK or India?
Your choice. A child born abroad has no entitlement to register as British if a parent gets ILR. The child will follow the same immigration path as the other parent and will also require ILR.
