BRP Expiring While Waiting On FLR (M) Extension

Hi all

We submitted 1st extension and attended biometrics appointment on the 23rd August.

Current BRP expires tomorrow- 8th Oct for my wife.
Will there be any recourse in the fact she remains in the UK, working etc but not in possession of a valid BRP card while our application is being processed?

I am guessing this comes as no surprise to some on here?

I called the UKVI number hoping to chat to someone but the recorded message says they will not be able to tell you anything! And then the options all go to pre recorded messages so in fact you cannot speak to anyone.

I assume we will not be subjected to a dawn raid by UK Boarder Force officers and my wife being deported, with a TV film crew in tow?

If you submitted an extension application before the visa expiry date, then Section 3C of the Immigration Rules kick in which means the previous existing visa conditions continue until HO has made a decision on the application.

She can continue to work and will not be an 'overstayer'.

Thank you so much for this info.

We will continue to wait for the decision from the HO. They have not yet asked for further info and we have been transparent with all our visas applications so hopefully this is no different.
My wife (Thai) is integrating into UK well, works, pays taxes, spends her earning mostly back into the UK economy so, fingers crossed.

Update. Picked up a letter from the post office as I missed it yesterday. Letter from the HO granting 30 month extension.

All good now for a few years!
