Tier 2 dependent and childrens ILR application

Post by Rocky24484 » Wed Oct 16, 2019 10:37 pm

Hi,

I was granted ILR visa in Jan 2019.

My wife first entered UK in 2014 October. and she's eligible to apply for ILR 5 years route.

Questions I have:

During her 5 years stay she was out of this country for almost 2 and half years but her last grant to remain was issued on 07-02-2017 and expires on 08-01-2020. Am I correct in assuming that 180 day rule will not apply for her as her leave was granted before Jan 2018.

I have started filling application form for my wife and noticed that I can also include child dependants.
Can i include my Daughter 3 years old and my son year and half to apply for ILR Set(O) application. Are they eligible to apply for ILR or do they have to stay for 5 years?

If children are eligible Can I add child dependants application along with my wife's. Assuming I don't have to create a separate application for each individual child.

Thank you for your support in advance.

Regards,
Rakesh.

Correct regarding absence.

The 5 year residence requirement doesn't apply to children under 18.they can apply when your wife does, assuming they are not UK born. If UK born, no need for ilr.
