2 weeks short for the 28 days for ILR

Hi

I came to UK in 2010 Jan 08 and my current visa expire in 24 Nov. Can I apply for ILR? Solicitor state you can but all say no.
I have a daughter who is born here and will be 8 in Dec.

Please advice

It may be possible, if you apply prior to expiry of leave and they decide after you qualify.

According to many members with fresh knowledge & experience about section 3C the person should be qualified for ILR on the date of decision. For this purpose the application can be sent now and biometrics can be booked on or around you qualify for ILR. In past few years ago when postal applications used to be made then such practice never be accepted rather the application returned back as invalid and the best practice was to apply extension or for an eligible category of visa and then vary into long residence ILR application.

If you fulfil all requirements for for Long Residence.. 10 years legal stay amongst others.
Make an “in time” application ie just before current visa expiry.. ur current leave shall be extended by virtue of 3C leave. Book biometric enrolment appointment for FIRST ENTRY DATE minus 28 days. This ensures the decision is taken in ur qualifying period.
