ILR Application - 5 Year Route

Dear all,

My 5 year on Tier-2 general visa will be completed on 31 December 2019. I am planning to apply on 04 December 2019 (approximately 28 days before). I want to confirm if I need to click submit on the online application on 04 December 2019 or can I do that now (and book my biometrics appointment etc. for 04 December 2019).

I have filled my application online, saved it, got HR to generate employers letter etc on 05 November so that it is not more than 1 month old, I will have all other documents ready.

However, I wasn't sure that what did HO mean when they say don't apply too early.

Date of application is the date you submit and pay online, so you should ideally submit when within the 28 days grace period.

@CR00, thank you so much for your help.

I appreciate that you might not know this exactly and will depend on the number of applications submitted at the time.. But if I was to submit my online application on 04 December 2019. Will I need to then book a biometrics appointment after submitting my application or will my decision be made instantly in 24-48hours as I am going for the super-priority?

I am concerned that when I submit my application on 04 December 2019, there might not be any appointment for biometrics available for the next few weeks and this will delay the decision.

Essentially..
You can upload ur documents any time before the interview..makes no difference.. just ensure sopra appointment is within qualifying period..
Read continuous residence guidance.. you’ll find a paragraph pertaining to qualifying period and decision taking date..
I think you’ll be fine.

Calculating the specified continuous period
Applicants can submit a settlement application up to 28 days before they would
reach the end of the specified period.
You must calculate the relevant qualifying period by counting backward from
whichever of the following is most beneficial to the applicant:
• the date of application
• the date of decision
• any date up to 28 days after the date of application

But for peace of mind , I would play it safe by submitting the online application on the date you qualify say 12:30 am and hope to get a paid appoint for the biometric on that same day or the next.

you have waited for 5 years, a few days won't hurt, would it?

The reason I was rushing to submit online application was because:
- I thought it will be very difficult to get a biometric appointment on 04 December 2019 for the next day or something
- I thought that submitting online and paying will mean nothing until I give my biometrics and they physically check my documents before submission at Sopra Steria

ok in that case then you can still apply but make sure your Bariometirc appointment in within the qualifying period.
