Transfer ILR visa to ROA entitlement

Hi,

I intend to apply for Right of Abode visa for my son who was born in the UK before either of the parent were settled in the UK. Currently all of us are on the ILR visa and my son's visa is expiring in next 6 months.

All of us hold Indian passports and my question is whether I can apply for ROA for my son instead of renewing his ILR visa?

Your child is not British. Simply being born in the UK does not give him any right to apply for ROA.

You have to register the child as British first on form MN1. This is a voluntary acquisition of another citizenship and he will lose his Indian citizenship from the date of approval and certificate issue.
