PBS Dependent Queries - Tier 2 General

Post by kingdom786 » Mon Dec 09, 2019 4:17 pm

I have got ILR recently via Tier 2 General and now applying for my wife PBS dependent visa to complete her 5 years as Tier 2 dependent. Questions from application as follows:

Q1. Length of husband’s certificate of sponsorship? As I have got ILR now so don’t have any COS. When I was on Tier 2, I had COS of up to 3 years.

Q2. Is their (husband’s) work in a shortage occupation? When I applied for ILR, my occupation was not in shortage occupation and I applied with £35,800 salary but recent changes in October 2019 covered it under shortage occupation. What should I select? Yes/No?

Q3. My company’s Sponsorship licence has expired after I received ILR, and they haven’t renewed it. Does this effect my wife’s PBS dependent extension application as question asks whether my sponsor agreed to certify maintenance?

Q4: My wife’s current leave to remain issue date? Is this the start date on the vignette in her passport (valid for first month) OR start date on BRP (collected after arrival in the UK)? Just to note here that vignette starts later than BRP from 10/12/2018 but BRP starts from 21/11/2018.

Q5: It’s been one year since my wife has been here and we don’t have much bills to her name apart from her Driving licence, NHS letter and a Bank statement. Is that sufficient?

Kindly help

You have posted in the ILR sub forum. Can you clarify that you are applying for a visa extension for them and NOT applying for ILR??

My apologies. I'll re-post this in the relative section. I am new to immigration boards and didn't know this.

Q1. Length of husband’s certificate of sponsorship? As I have got ILR now so don’t have any COS. When I was on Tier 2, I had COS of up to 3 years.
You need to state the last CoS details you had.
Q2. Is their (husband’s) work in a shortage occupation? When I applied for ILR, my occupation was not in shortage occupation and I applied with £35,800 salary but recent changes in October 2019 covered it under shortage occupation. What should I select? Yes/No?
It is based on what your last SOC and CoS was as far as I understand.
Q3. My company’s Sponsorship licence has expired after I received ILR, and they haven’t renewed it. Does this effect my wife’s PBS dependent extension application as question asks whether my sponsor agreed to certify maintenance?
Your sponsor is irrelevant to the PBS Dependent extension. Your dependent is dependent on you not your sponsor. Also, as you hold ILR, even if your sponsor did have a licence, they cannot certify maintenance for your dependents anymore. You have to prove maintenance funds of £630 per dependent for a minimum of 90 days.
What date was in the approval letter? Likely the BRP date.
Q5: It’s been one year since my wife has been here and we don’t have much bills to her name apart from her Driving licence, NHS letter and a Bank statement. Is that sufficient?
You need documents in both your names since she arrived in the UK to prove subsisting relationship, from at least 3 difference sources, with each spread evenly for every 3 or 4 months.
