540 days

Hi I was hoping to get some advice pls.
I have been in the UK lawfully since sept 2008. I was a student then worked here till now. It has been a period of continuous leave of 11 years and 2 months.

There is no continuous absence of 180 days continuous. I have however 550 days outside the UK but this over a period of 11 yrs and 2 months. Over any 10 year period I do not exceed the 540 limit.

Will there be any issue with applying for an ILR.

I was on a tier 4 visa from sept 2008 to aug 2015. I have been on a tier 2 visa since aug 2015 till now. It has been a period of continuous leave.

Have been in Uk for 11 yrs and 2 months. Not been out of he country longer than 180 days in a row. However over 11 years and 2 months i have been out of the country for 550 days.

Over the 10 year period from sept 2008 to sept 2018, i accumulated less than 540 days our of the country. But over 11 years 2 months its 550 days.

I had a look at the eligibility criteria, its not apparently clear if this is ok or not.

Another option for me is to apply in aug 2020 as i would have been on a tier 2 for 5 years. But just wanted to sort it out now.

Super priority service

I am currently doing my ilr application. In the payment option, there is no choice offered for the super priority service. Why is this?

if You have not spent more than 180 days in any year in your qualifying period, you are ok.

High demand, no availability. The absence limit is 540 days over the 10 years qualifying period only.

Hi all,

I got an email today after applying via the super priority service.

It says;
Thank you for your application for permission to stay in the UK.

Although we would normally decide your application prior to the end of the next working day from the date it was submitted, unfortunately this is not going to be possible in your case.

This is because your application raises exceptionally complex issues and we require further time to consider your case thoroughly and reach a decision.

This is because your application was originally decided on date and has only recently been re-opened.

I am sorry for the delay in dealing with your application and for the inconvenience this is causing. Please be assured that we are doing all we can to make a decision on your case as quickly as possible.

We will refund the super priority element of the fee you paid (the difference between the cost of making a standard application and a super priority application). We will refund the amount of £800 to your credit or debit card in due course.
We expect to make a decision on your application in due course



Its made me so stressed! Applied ILR through 10 year route.
Been on tier 4 for 7 years then tier 2 for 4 years 3 months.
Been in the country continuously for 11 yrs 3 months. Basically, over any 10 year period I have NOT exited the 540 day limit but over 11 yrs 3 months I have. I read the guidelines and thought it was ok. They didn't elaborate on the issues they were referring to.

If my application gets rejected will I get a refund of some sort?

Normal email, many get it.

Obviously something they need to check.

Hopefully not your absence for the 10 years counting backwards from the of application, if you were over 540 days.

I think you should allow panic at this time. Wait for outcome, if negative (God forbid) push for AR and while that is on vary to LR. I think this should be possible and you will yet be within your 3C provision.

What is AR and LR?
And I know no one is probably going to be able to answer this, how long will it be till I hear back? I emailed the worker who emailed me this reply but no response.

What is AR and LR?
AR = administrative review which is for when you believe HO made and error.

LR = long residence.
And I know no one is probably going to be able to answer this, how long will it be till I hear back?
It can take a couple of weeks and up to 6 months.

6 mnths! I dont think ill cope with that stress.

Any point contacting ukvi asking for more info?

Also if application gets rejected would I be entitled to a refund?

They won't give you more detail and as they have already written to you that it will take longer, not Kuch more you can do to wait.
Also if application gets rejected would I be entitled to a refund?
Refund for what?? If ilr is refused you do not get a refund of the application fee. It is lost.

I just got an email 5 mins ago stating my ilr has been granted. Thank God!
