UK Spouse Visa Questions

Post by GenevaJet » Mon Jan 13, 2020 1:48 pm

The requirements for the visa state I (British partner) need to supply "A letter from an employer which includes the job title, the period he or she has worked there, the current salary and also payslips". My employer does not write job references explaining my salary etc. but instead inform employees to use their job contracts.

My job contract states my annual salary is 14k GBP per year and makes no mention of overtime. For the past 5 months I have been doing overtime which has allowed me to meet the financial requirement of 18.6k GBP per year. Is there a section in the application to properly explain this so they don't just look at my contract and refuse it?

Secondly, it asks us to provide details of my wife's previous immigration applications as well as her parents' details (Dob, nationality etc). Is there a section on the application for this also or must we provide their birth certificates and whatnot?

Thanks.

The immigration rules state it clearly.

2. In respect of salaried employment in the UK (except where paragraph 9 applies), all of the following evidence must be provided:
(a) Payslips covering:
(i) a period of 6 months prior to the date of application if the person has been employed by their current employer for at least 6 months (and where paragraph 13(b) of this Appendix does not apply); or
(ii) any period of salaried employment in the period of 12 months prior to the date of application if the person has been employed by their current employer for less than 6 months (or at least 6 months but the person does not rely on paragraph 13(a) of this Appendix), or in the financial year(s) relied upon by a self-employed person.

(b) A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:
(i) the person’s employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

Birth certs not required,
