I have a British passport(was born there) but living in Australia
Ready to go home.

What is the best way to get my Australian husband there... A spouse visa? So I go home and apply for him or take him with me at the time and take all our savings? He has a British mum living in Australia and two British children aged 18 and 16. My step kids. He lived in London for 3 years and had a British passport before but it ran out and never renewed. (When I met him) We have two Aussie kids together 14 and 12. Do they need a family visa or dual citizenship?

All My Family live in northern Ireland, mum, dad , sister all cousins

He should renew his British passport, easiest and likely only way for him as a British citizen can't apply for a visa to enter the UK.

Your children too, apply for their passports as they are British by descent.

He was told he wouldnt be able to renew it.

I am not sure who told him that but he told me that

Not sure why he wouldn't be able to if he had one in the past. Unless he has willingly renounced his british citizenship which seems unlikely if he has two British children (your step children) or wasn't entitled to one in the first place.

How did he qualify for a passport before?

I think it was supposed to be a family thing because at first he was living with his family (aunt)

His mum and dad settled here but all his aunties Uncle's and. Cousins still reside in london and all my family reside in belfast. The. Older kids birth mum lives in London too

If he is British he is British and can have a passport.

Assuming that father is not a British citizen AND that his parents were married at the time of his birth (and you will want to check on that), I would say that your husband is not a British citizen (as mothers could not pass on British citizenship to their children before 1983). However, your husband can apply to register as a British citizen using Form UKM. It would only cost £80.

His previous British passport may have been issued in error or there may be details of his father (such as his father also having been born in the UK or of his parents' marriage at the time of his birth) that we are unaware of.

In any case, assuming that he has always been a Australian citizen, he would also be eligible to claim Right of Abode through his mother, even if he is not a British citizen.
