Spouse of a naturalized British citizen

Post by Didaka » Sat Jan 18, 2020 2:04 pm

Hi,

I need an advice. My spouse became a British citizen by Naturalisation one year ago. I have a Permanent resident document and I want to apply for Naturalisation as I would like to include my 12 years child who has a Permanent resident document, too. We are EU sitizens and we have been residents in the UK for 6 years. My child was born outside the UK before we got our PR statuses. I have some questions.

1 which way to apply is better for our situation - as spouse of a British citizen or as a person who has permanent residence status?

2 I am not sure about the requirement for a spouse of a British sitizen - "lived in the UK for at least 3 years" - 3 years after my husband became a British citizen or the last 3 years in general?

Thank you!

1. Makes no difference really as permanent residence is required for both.

2. It is just 3 years residence and married to someone who is British at the time if your application.

Thank you for the fast replay.

I could not understand the answer of my question 2. My husband became a British 1 year ago. We have been married for 12 years but he was not British before. Do I need to wait 2 more years ( because he became British 1 year ago) or I can apply now as spouse of a British sitizen?

Thank you!

There's is Jo requirement that you must have been married to a British citizen, who has been british for 3 years.

If he became British yesterday, you are still eligible to apply as the spouse of a British citizen.

The 3 year residence requirement is separate to the "married to a British citizen at the time you apply"

The 3 year residence requirements has less absence limits and you need to have been physically present in the UK at the start of the 3 year period.

Hi,
I have questions regarding BC referees. I understood that I will be able to download a Referee declaration
after I fill the online application, submit and pay.
1. Are there any recent changes in the Referee declaration?
2. In recent posts here I found a link for a Referee declaration. Is it going to be a problem for the Naturalisation if the referee signs the declaration before I submit and pay the application? The date of the declaration will be before the date of submiting.
Thank you for your help!

Thank you for the fast response. I do apologise but I am not sure that I understand correctly. Can the Referee declaration have an earlier date from the date of submitting?
Sorry for the inconvenience!

Yes!. However you are likely only able to download/print the referee form near the end of the process

I was thinking of downloading the declaration from the link I found ( before finishing the application ) because if I have to download it after I pay I will not be able to make any changes regarding the referees- in case some of them change their mind. Is it ok?
I am not sure are there any recent changes in Referee declaration form?

apply for Naturalisation. Is it a change of circumstances?
Thank you in advance!

This is a change post-application and not material - no need to advise HO.

Hi,
I am in the process of searching of professional referee for my daughter. Her class teacher declined.
Can I use a nurse who knows her very well for a referee? The nurse works at a Private clinic.
Thank you in advance.

Hi,
I forgot to mention that the nurse is not a British citizen and has a passport from EU country. In that case, can I use the person as a referee?

Thank you!

If using the nurse as the PROFESSIONAL referee, they can be of any nationality and do NOT have to be British.

The other referee must be British and over 25 and do NOT have to be a Professional.

Hi,
Would you advise me please. I am not sure what kind of documents to submit for my daughter. She is born outside the UK. I will submit her passport, PR document, birth certificate and our marriage certificate.
Do I need a letter (for attendance) from her school?

Hi,

I submitted my British citizenship application ( week ago ) and I have an appointment for biometrics on 29 February at 14:00 o'clock. I paid for checking service but still haven't received a message or an email for the result of checking. Is it normal? Should I contact them? Are they check the documents at the appointment?

Thank you in advance!

What do you believe the checking service is? What exactly did you pay for as a service??

You have likely only paid for a scanning service.

No one checks your application and lets you know it is ok. You appear to have misunderstood the ukcvas sopra steria service completely. They are only scanning, identity check and biometric enrolment agents.

Hi,

Thank you for your reply.
I didn't explain correctly. I know that they don't check
the application. I wanted my uploaded documents to be checked in advance before the appointment. There was an option to pay extra services. I chose "document checking" service and I paid SMS service, as well. UKVCAS should do it before the appointment and they have to send me a message for the result. I read this on there website.

"Document checking
You can buy the document checking service if you want our team to check that you have correctly uploaded the documents for your appointment, that the scanned documents you provided are of an acceptable quality and are complete.

To use this service you must upload your documents through our website at least 2 working days before your appointment date."
