Spouse divorce after IRL will affect BC?

Post by cnc » Mon Feb 03, 2020 6:48 pm

I have had ILR for 6 months under the 5 years spouse route. My husband has
been cheating on me recently, he is leaving me for this woman and he
wants to get divorce me.
The gov website states that you must tell the Home Office when you divorce
your partner if the visa is based on the relationship. will this apply to
me?
I have been living in the UK for 6 years. Will this affect my current
status as I obtained the ILR as a spouse? And will this affect me to apply for BC? I understand I will have to wait 12 months after ILR. Will I still qualify being divorced?

I appreciate your comments.

No it does not as you hold ilr and are not dependent on your spouse.
Will this affect my current status as I obtained the ILR as a spouse

No.
And will this affect me to apply for BC?

No.
I understand I will have to wait 12 months after ILR.
No. As long as you married, even if separated, you can still apply as soon as you got ilr. You need to upload spouse passport though.
Will I still qualify being divorced?
Yes!!

Thank you for your reply!

RE: 'You need to upload spouse passport though'. We are starting the divorce process and I plan to apply for BC after the divorce is finalised. Will I need to upload his passport for the application then or just the divorce certificate?
Also our daughter has ILR but she is now an adult. If we get divorced will this affect her in any way when she applies for BC? I wonder if anyone had a similar scenario. I appreciate your advise.

Once divorced, you need 12 months on ilr before you can apply.spiusr passport won't be required as you will no longer be married.

Divorce cert is also NOT required for citizenship.

No!!! She must qualify and meet all the requirements on her own.

There is NO "dependent" concept for citizenship. Each person applying must meet the requirements individually.
