BRP card for 2,5years terms

Post by Nat05 » Thu Feb 06, 2020 9:13 am

Hello, I got BRP card type leave to enter which is leave to remain (the same thing apparently) for 2,5years. I am planning to apply for citizenship if future because I am married to British. I must live in UK for 5 years in order to apply for ILR and then to citizenship. For how long I can be absent from the UK in 12 month period in order to be eligible for citizenship? Is it 90 days per year?

Thank you.

There is non "90 days in 12 months" rule!!

For citizenship based on 5 years residence it is no more than 450 days in the whole 5 years and no more than 90 days in the 12 months immediately preceding the date of application.

If applying as the spouse of a British citizen based on 3 years residence, it is no more than 270 days absence in the whole 3 years and 90 days in the 12 months immediately preceding the date of application.

So 90 days absence applies only to the last year before my ILR application? And 270, 450 days I can divide accordingly... For example 270 days for 3 years: 1y.- 65days; 2y.-115days; 3y.-90days. Is that correct?

It is irrelevant how your absence is spread for citizenship. There is no rule about a maximum per 12 months.

Do you mean applying to ILR in 3 years?
Also can you bring an example on how I can use those 270 days?

No,citizenship. You need 5 years residence before you can apply for ilr. Citizenship comes under different laws to applications under the immigration rules.

My answer was fairly clear and not cryptic. You simply cannot have more than 270 days absence in total during the 3 years preceding date of application for citizenship. It makes absolutely NO difference whether you take in two chunks or all at once.
