Family Visas: Spouse Application (Bangladesh)

Post by AA19 » Fri Nov 08, 2019 9:58 pm

Hi,

I hope I am posting correctly.
I (British Bangladeshi) have recently married back home and I have some questions please.

Firstly, I’m on a fixed term contract and unfortunately it’s been cut short till end of December now. We have internal communications to say they may bring us back in January (which I can submit) but I am not sure how long the fixed term will be. I have been working for my employer for nearly a year and half now and earn well above the threshold. My employer deals with the standards in terms of tax etc as usual and I have online payslips available to print.

My question - is it okay to apply for my Mrs near the end of November seeing as I may not be employed while they do the investigation?

Please note, I am thinking of applying on Priority basis and my wife will seat her English test around 20th of November.

Many thanks.

Your that plan will only work if by miracle HO will not contact your employer and many times they don't. Also priority fee doesn't guarantee that you will get decision swiftly rather checks & verifications might delay the process. But safest option will be if they temporarily extend your contract even give you another role at least until your application gets decided or you search yourself a new job before submitting the application.

Hi, thanks for the reply. I am actively looking for a job.

My employment letter will say my end date and with supporting internal communication regarding re-employment wouldn't it be considered?

Correct me if I'm wrong but doesn't the HO look at past earnings (£18K+) or do you have to satisfy future earnings too?

It should also state your wages, job title, length of service etc and must not be older than 28 days from the date of application.

Under category A & B you must have earned the required income means past & present matters.

Thanks seagul.

I have been offered a day rate contract role via umbrella company which will start on 13th Jan 2020 till end of May/June 2020 with view of extension for. I have also been offered a new contract by my current employer on a fixed term from 2nd of January 2020 till end of March 2020 salary based also with view of extension (note I am due to end my current employment on 20th December).

Can you please advise me which will be most suitable for the application and what are the rules around employment gap?

I am still seeking permanent employment.

Much appreciated.

Try your best to find a job which contract last at least until the application decision but still in the worst case, better to join the contract which your current employer has offered you with the hope to have your application either be processed before march 2020 or your contract gets extended. Also try to inform UKVI beforehand through your employer letter and own covering letter that you won't be working after march 2020 and maybe by doing so they might contact your employer before this date if needed.

Thanks Seagul.

If I may ask another question, I have the Telephone/Broadband bill under my name as well as mobile but I've come to realisation this is not considered as utility bill?

I am trying to get the water bill under my name and wanted to know how many months bill is needed - Is one month (Jan) bill accepted?

Hi,

I finished work with my employer in January and I was supposed to start another job this month (Feb) but it didn't go through.

Can someone please tell if I can still apply if I manage to get a job in March which would mean I would have 1 month gap in February?

Thanks in advance.

Assuming you haven't applied yet . . . If your total income in the 12 months prior to the application date and the salary of your new job both meet the financial requirement, then a gap doesn't really matter as you would still qualify using category B.

Thanks for your reply.

Has anyone been in a similar kind of situation?

I had a gap in employment as I changed jobs a few months before a visa application - no issues. Under category B, all that matters is that current salary and total income in the 12 months prior to the application date both meet the financial requirement.
