Spouse Visa Refused - Employer Failed to send Tax to HMRC

Post by bijay2019 » Sun Feb 16, 2020 9:54 pm

Hi,

My wife's (spouse) visa got refused last week Monday. We had applied on 17th Sept 2019 from Nepal.

Reasons for Refusal: I (ECO) am aware check with HMRC that Real time Information (RTI) provided on 7/2/2020,....... HMRC record no employment with xxxxx company and no employments whatsoever in the current tax year 2019/2020.

If only ECO would have called my employer my wife would have gotten the visa. I had provided 6 months payslip, 6 months bank statement to show payslip matches with my bank statement and NHS employment letter from my manager. I have been with the current company for almost 1 year and 7 months now.

Last Thursday I spoke to Account (who made a mistake not sending my tax to HMRC) and have rectified it within 24 hours of asking of it. I still need to verify with HMRC on Monday which I am sure it will ok.

The reason I am writing this is, Has anyone has come across this kind of case. If so please if you could please advise me what to do next. Do I have to do an administrative review with HO or need to go to the court? How long is the wait for?

Thank you

You should appeal the decision. You can check online your employment and tax details on hrmc website.
