Child Born In India

Post by md_ismaeel » Thu Feb 27, 2020 9:07 pm

Hi everyone

Just a quick question about Child Naturalisation. My son was born in India on 2016 and i got my ILR on 2018. Is he eligible to apply for British naturalisation ?

Thanks in advance

Short answer is NO.

Children born abroad require ILR and can then apply for citizenship when either parent is also applying and the other parent holds ilr as a minimum.

The child will have to apply for the same visa as your wife and will qualify for ilr when your wife does.

There is no shortcut route for your child as the child was born abroad.

The UK Immigration status of children born abroad follows that of the less-privileged parent. So, the child will have the same immigration status as the other parent and will qualify for ILR when the other parent qualifies.

Had the child been born in the UK, you could have registered them as a British citizen now.

EDIT: overtaken by CR001.
