Tier 2 General & Dependent (ILR applications)

Post by Richie1 » Tue Mar 03, 2020 8:40 pm

Currently my wife is on Tier 2 General visa and I have Tier 2 dependent visa.

She is eligible to apply for ILR in April 2020; she will meet a requirement of working with Tier 2 General visa for 5 years.

My Tier 2 dependent visa is valid from September 2016 and will expire in April 2021 (just 5 month short of 5 years).

Under these circumstances, I would like to seek advice on my visa status.

1) Do I need to change visa status when she changes from Tier2(General) to ILR?
My visa is valid until April 2021 and I wonder the change of my wife's visa status will have an effect on my visa. Do I have to change my visa as well when her application starts?

2) If I have to change my visa status, which visa would you recommend?
My 5 years in the UK will be September 2021. I would like to apply for the visa type which would allow me to continue my 5 years.

We briefly spoke with an advisor and the advice was to switch to General visa (not sure what this is!) and I would be eligible for ILR next September.

Looking forward to your advice.

Thank you very much.

1. No. You can extend your current visa before it expires until you meet the requirements for ilr.

2. Don't change visas otherwise your clock resets to zero.

You have been given incorrect advice. There is no requirement to change visa category and I suspect the "advisor" has no idea what they are talking about as there is no "general" visa category.

Thank you very much for your quick response.

I was reading the “SWS_Dependant_Guidance_02-2020” looks like page 4 is setting out steps I need to follow https://www.gov.uk/government/publicati ... rs-1-2-4-5
* stay on Tier 2 dependent
* extend it before it expires, at the time of extension my wife would be on her ILR
* this way I can count continuous 5 years for my ILR application in September 2021

Then can I please ask another question about the Tier 2 dependent extension application (when my wife is granted ILR)?

Can I use the general extension form for Tier 2 dependent? Please refer to provided link below. I am wondering if there is a section stating the status of the (previous) main Tier 2 holder.
https://visas-immigration.service.gov.u ... 1581427891

Thanks again for your advice, looking forward to hear from you.

Kind regards,

Richie

Yes, you use the PBS Dependent form to extend your visa. It will be a 3 year extension.

Tier 2 dependent visa extension when tier 2 main applicant obtained ILR

Post by Richie1 » Mon Jan 04, 2021 9:01 pm

Hello

I have dependent tier 2 visa which will expire this April and I will be eligible to apply for ILR this September. My wife (tier 2 main applicant) had tier 2 visa and obtained ILR last year.

I heard that I can extend my visa (dependent tier2). So, I was wondering 1) when I could extend my visa, 2) which process I need to start with (I searched for the process online but there are not much information on my case), and 3) what documents I have to prepare for.

I would appreciate it if you help me extend my visa soon

Thank you
Richie

1. At any time before visa expiry. Regardless of when you apply before your visa expires, it will be a 3 year extension.

Thank you for reply.

One more thing, I would like to have something to check.

In the application form, there is a blank to put down my wife' home reference number (Enter their Home Office reference number). My wife had tier 2 visa and obtained the right of permanent residence (ILR) in the UK last year. So, I wonder which number I have to put down.

1) Home Office reference number for tier 2 visa or 2) unique application number for ILR.

Please reply and thank you

one more thing

when I pay immigration health surcharge, I have to put down work start date and end date like below
(Like I said, my wife had tier 2 visa and obtained (ILR) last year)

Could you please let me know what it means? (Does it mean my wife's tier2 visa period? issue date & valid until?)

Visa route: Dependent
Visa type: Skilled Worker (Dependant) 3 Year
Work start:
Work end:

Please reply thank you

Could you please let me know if it is OK to attach family consent form with digital signature? it is hard to find a printing shop open due to Covid-19.

Put an end date of 3 years from the date you apply to get the correct IHS.

It doesn't matter which reference number you out and it also an "if known" question as far as I am aware.

Post by Richie1 » Sun Jan 10, 2021 1:33 pm

Thank you

when I pay for health surcharge, I need to select my wife's visa route and visa type (The person you're joining or remaining with)

My wife had Tier 2 (General) and obtained ILR last year

What I can select in the visa route is like below

[ The list of the visa route]
Dependant
Discretionary Leave
Further Leave to Remain - FLR
Further Leave to Remain Human right and other claims
Further Leave to Remain Immigration rules
Further Leave to Remain Other
Global Talent
Intra-company route
PBS Dependant (Global Talent)
PBS Dependant (Tier 1,2, and 5)
Skilled worker
Student
Tier 1
Tier 2
Tier 2 PBS Dependant
Tier 4
Tier 5

I think that I need to select tier 2 in the visa route but I can't select tier 2 (general) in the visa type.

What I can select in the visa type is like below

Tier 2 (Intra-Company Transfer) Graduate Trainee
Tier 2 (Intra-Company Transfer) Short term staff
Tier 2 (Intra-Company Transfer) Skills transfer
Tier 2 (Minister of Religion)
Tier 2 (Sport person)

Could you please advise me about the visa route and visa type?

Many thanks

Hello

I've found out that I have to select skilled worker (Tier 2 General is replaced with Skilled worker from 2021)

However, I don't think IHS calculation worked out to be correct. (The calculator shows 312 GBP in my case)

Following is information I filled in.

1) Person you are joining with - based on my wife's Tier 2 visa information, I put down the expiration date
is 07.04.2021 (skilled worker); My wife obtained ILR and the expiration date of her tier 2 visa is 07.04.2021

2) Calculated - £312 which I don't believe is correct for extending Tier 2 dependent visa (3 years). I think the calculator considered only 3 months although my case is 3 years extension

Please let me know what was wrong and how I can fill in the expiration date.

Thank you
Richie

1. Put an ilr expiry date of 3 years from date of application to get the correct IHS fee.

Hello thank you for the reply.

I applied for the 3 years extension.

According the document check list, what I have to submit is 1) my passport 2) my BRP card and 3) document (such as council tax, bank statement or and so on) as evidence of living my wife together.

I do not think I need to submit my own bank statement to show that I can support myself because my bank statement is not on the check list. However, the government guidance seems to require me to submit it and so I would like to check if I need to submit my bank statement. please help me
