Looking to move to the US with Ancestry visa queries

Hi everyone,

I am an Australian citizen currently living in the UK on an Ancestry Visa (Tier 1), which I successfully applied for June last year (2019).

My partner (also an Australia citizen) who successfully applied as a dependent on my UK Ancestry Visa as of September 2019 is living with me in the UK, but has been offered a job in New York, USA. The idea is that he would transfer on the Australian E3 visa to live and work there, and that I would follow suit on the E3 visa a few months later (all of which would be this year and well within the 5 year period given to us with an Ancestry visa).

IF things didn't work out in New York and he wanted to return before I applied for the E3, could he return as a dependent on my UK Ancestry Visa, despite the fact he has obviously looked to live in a different country and was separate from me? We have no intention of applying for indefinite leave in the UK - there are very clear rules around how long you can leave the UK if you are. Our query is more around applying for visas in other countries and whether that is in violation of the Ancestry Visa terms and conditions (and as a partner, if it looks like you intended to live apart at all, if that would be in violation of the visa).

My second question is, if things were going well in New York and I moved over on the E3 as well, could we (within the 5 year period given to us with an Ancestry Visa) return to the UK to live and work on the same Ancestry Visa we had originally? For example, we lived in New York on the E3 for 2 years, then decided to return to the UK to live another 3 years, would that be possible without reapplying for anything?

Your ancestry (not a tier 1 category) is irrelevant to other country visas. It doesn't get cancelled if you apply for other country visas.
