Tier 2 ICT Dependent to Tier 2 General Visa Conversion

Post by sagarw693 » Mon Mar 09, 2020 3:07 pm

Hello,

My partner is currently Working in UK under ICT Tier 2 PBS dependent Visa from last 1 year, now her Employer is ready to sponsor her and convert her Visa from PBS Dependent to Tier 2 General Visa. But not sure how it should be done, We got to know some of the checks, If anyone could confirm please the below points:

1) Employer should have the license to Sponsor Tier 2 General Visa to a worker, if not then they need to apply for the same, is it there any fees to apply for the license?
2) There are 2 types of COS - Restricted & Unrestricted, not sure what COS should be generated in this case,If you could confirm please?
3) What would be the total cost of the Tier 2 General visa conversion from Tier 2 ICT Dependent Visa?
4) Does my partner needs to leave the country while doing this Visa conversion process?
5) What other things should be taken care of while doing the same?

Waiting for the response, Many thanks in Advance!

1. Yes there are. Read the sponsor guidance note.

2. Restricted CoS, new hire, as she has to apply from outside the UK.

3. She is not "converting", she is applying for a new entry clearance visa in a different category and rules. Visa fee in pink below plus she has to pay IHS.

4. Yes.

Hello,

Many thanks for the response.

1) Yes, confirmed they have the license.
2) Understood from the "https://www.gov.uk/tier-2-general" under the Switch visa section, she doesnt fall under any category in which she can stay in UK and apply from here so that she has to leave UK and apply from Home country, give Biometrics & other required documents.

I have few more queries, if you could answer please:
1) Does her Employer needs to generate a new demand for the Job, as she is already working there from last 1 year, so not sure if that is required?
2) Also, she is a Chartered Accountant in India(Degree from ICAI) and a Bachelor Degree in Commerce and work experience of 1 year in UK and 3 years in India, does she still need to prove her "Knowledge of English" by giving an external exam?
3) She has got the dependent visa for 2 Years, will it get cancelled as soon as we apply for the tier 2 general visa or will it get cancelled when we get the approved Tier 2 General Visa?
4)(Not sure if this question is valid) In the negative scenario, if General Visa application is not successful, what will happen to the dependent visa which is there already and valid for 2 years?

Many thanks again!
