Reissue of COS

Most respected members,

My colleague visa was refused in January 2020 as home office said that his education is not related
to the nature of Work permit he got he did admin review which was rejected. Now if he get the COS
again from the same employer is he eligible to apply again and also is he needing for the labor test.
