query about length of dependent child settlement visa

Post by coopd6 » Wed Apr 08, 2020 6:13 pm

Hi all,
I had a query about the length of time normally given for child dependent settlement visas. My wife arrived in the UK on a spouse visa in October 2017, and was given 33 months in total, so her visa is expiring soon in June 2020 and we plan to apply for an extension of this. Her daughter was given a settlement visa as a dependent, but we had applied for this after my wife had already arrived and established herself in the UK. So my stepdaughter was given the visa in July 2019 and she arrived in UK the following month (she had already turned 18 years old at that point). I had assumed she would also be given 33 months initially, but her BRP has an expiry of September 2020, making 14 months in total from the award of the visa. Unfortunately we never received the visa letter from the Home Office when the visa was first awarded that might have explained things. Are child dependents given different length visas? That seems a bit odd. I thought it might be possible that they align her visa expiry with her mother, so expiry in June, but even that doesn't fit here? Or is it just that the BRP document itself has an initial expiry and has to be renewed, but her visa might still be the full 33 months? If anyone who has any insights in to this, I'd be very grateful,
Thanks
Coop

Probably you had wrong endorsement,I believe the child should get the same 33 months so will report the BRP

Many thanks for that. Yes I was certain that the initial visa length for child dependents would be 33 months, regardless if the mother had already arrived in the UK. Perhaps they have simply put the wrong expiry date on the BRP, I will check this out. The expiry date on the BRP happens to be the birthday of the mother, so perhaps they have mixed up the information somewhere along the line. Thanks.

The childs visa should have the same expiry date as the mothers visa.

This should have been checked and reported when the BRP was collected.

Ah ok, thanks for that. I thought the expiry dates for the mother and child were only aligned when the child visa was extended, and that for the initial visa the child would still get the 33 months. Unfortunately we never received the letter from the Home Office when the visa was first issued so we weren't clear on what had happened and didn't chase it up when we first collected the BRP. In any case, I'll report the problem with the BRP and see what they say, thanks.

See what they say first otherwise they might ask you to pay to get it rectified as I remember reading that you should report any problems within 5 days but I can’t remember where.

Yes, I will try to clarify it with them first. It looks like normally you would need to notify them of an error in the first 10 days after collection. We checked the personal details, but unfortunately didn't pay close enough attention to the expiry date. The main thing I want to ensure is that we don't miss the cutoff for extending the visa, so hopefully they can clarify that at least
