switch from Tier2 general dependant to Tier2 general main applicant

Post by satyavakada » Thu May 07, 2020 12:38 pm

Hi team,

I am currently on a Tier2 general dependent visa from February 2020 now my current employer is willing to sponsor me for tier2 general main applicant. I am with the same employer before as a  tier2 ICT main applicant and now I am working with them with a Tier2 general dependant visa. Now due to the COVID situation, my spouse who is currently on Tier2 general main applicant may lose the job. My questions are:

1. can I change fromTier2 general dependent to the main applicant with the same employer?

2.since I have changed visa in February 2020 from Tier2 ICT main applicant to Tier2 general dependent, can I change now to Tier2 general main applicant or do I need to serve cooling period and apply for the Tier2 general main applicant only after Feb 2021?

3. If I change to Tier2 general main applicant do I need to apply from my home country or I can apply within the UK?

4. If I change to Tier2 general main applicant can my dependents change to the dependent visa within the UK?

Thanks

If you have only been on a dependent visa for a couple of months and prior to this you were on ICT visa, you are subject to the 12 month cooling off period before you can apply for a tier 2 general visa.

1. Yes, possible, if you meet the requirements. You have to apply from home country.

2. Cooling off period applies to you.

3. Home country.

4. Yes.
