I'm also not 100% sure what type of visa my wife has got, so if there is a method to check that that'd be great as it's not in her passport and i can't the documentaion from 2.5 years ago

thanks

What does her BRP card say?

What did she originally apply for?

Are you British or hold ILR??

hi
I'm british, we've 2 uk national kids together.
her brp card doesnt say anything about her visa, only LTR with no public funds.

i can't remember if we applied as a FLR(FP) or FLR(M).
2.5 years ago we did however forget the need to provide an updated english test so they refused our extension under 5 years and switched her on to a 10 years under R-LTRP.1.1.(a,(B)

thanks

If she is on the FLR(FP) 10 year route, then she can either apply on FLR(FP) and stick with the 10 year route (4 x 2.5 year visas) or she can switch to the 5 year route again from scratch on FLR(M) meeting the English and financial requirement.

so does that mean, from 2018 while she's been on the 10 year route

2018->2020 (she accrued 2.5years)
extend
2020->2022 (she's accrued 5 years)
extend
2022->2024 (she's accrued 7.5 years)
extend
2024->2026 (she's accrued 10 years)
apply for ILR

which would be over £10k in fee's :(

How long has she been in the UK and on what visas??

Yes, and that is based on the current fees. They increase each year. IHS fee is also increasing in October to £625 per year.

From October, for a 2.5 year visa, it will be £1562.50 plus the visa fee.

You don't need professional services to make this application. It is not a difficult application to make as it is all online. You would really only be paying a lot of money to someone to complete an online form for you.

Members are also not permitted to post names or details of professional services on the forum.

ok, thanks.

I just phone the help line advisors about switching back from 10year on to the 5 year route, and they said my best bet would be to write to the case workers and explain out situation and ask for them to port the visa back to 5 year since my wife meets all of the requirements the previous app just had a mistake on it.

Are you aware of anyone ever writing or having success in this route? Will I need a solicitor or just a friendly letter explaining/pleading

thanks

HO Caseworkers, surprisingly, do actually know the rules. If you apply on FLR(M) and meet and submit the English and financial requirements, they will process it based on the 5 year route as the 10 year route does NOT have the English or financial requirement.

Note also that the call centre is outsourced to a third party agent.
