Fiancee Visa application country

Fiancee Visa application country

Hello,

My fiancee is Australian and in the UK on a YMS Tier 5 visa, which expires in late August.

We were supposed to get married yeterday. We gave notice to marry in March before lockdown started, but this was put on hold due to lockdown. We have a feeling that, although marriages may be able to begin again soon, we will have to apply for a Fiancee Visa in order for us to get married, as there wouldn't be time for us to give notice of marriage again (because my fiancee's YMS visa runs out in less than 70 days).

I know that with Fiancee visas, you have to apply from outside the UK. In Australia (fiancee's home country) there is a mandatory two-week quarantine, so we'd rather not apply there. Are we allowed to apply for the fiancee visa from a different country, e.g. Ireland where there are no quarantine measures? We could spend the week there and do the priority service. Or do we have to apply from the fiancee's home country where they have a permanent address?

Are we allowed to apply for the fiancee visa from a different country,
She can only apply from a country where she has legal residence, ie not in a country as a tourist, which is what she would be in Ireland.

How long have you lived together in a relationship akin to marriage in the UK?

If you have already been given the go ahead to marry by HO, why do you believe you need to get HO approval again?

Thanks for clearing that up.

We don't live together, we are waiting until we are married.

We haven't been given the go ahead, unfortunately. We gave notice of marriage on the 13th March, lockdown started on 24th March. We never heard from the Home Office at all. The local council have not been able to help, they are just saying that the marriage section of the council is closed until further notice so can't help with our query. So we are in a bit of a limbo. This is why I think we'll be told to give notice again - but my fiancee's Tier 5 visa expires on 21st August so there probably won't be time.

Marry in Denmark or somewhere in Europe and then come back and apply before her visa expires.

Thank you for the advice, that is something we didn’t think of before.

Would a foreign wedding in Denmark look a bit suspicious to the Home Office when we apply for a spouse visa here?

Also what extra documents would we need for the marriage to be accepted in the UK and for the visa?

No.
Also what extra documents would we need for the marriage to be accepted in the UK and for the visa?
A marriage legally conducted overseas and marriage cert which is in English or translated, is accepted by HO.
