Babies born outside UK to a settled parent

Post by igorpavlov » Sat Jun 20, 2020 9:57 pm

Hello everyone!

I am Russian. I have settled status (indefinite leave to remain, not yet a UK citizen). My wife has a spouse visa (not a UK citizen). I am currently applying for UK citizenship now. Expecting a baby soon. As a matter of preference, I would like my baby to be born outside the UK.

I have two questions:
1) If my UK citizenship does not happen prior to baby birth, would it be possible for my baby to become a UK citizen once I obtain UK citizenship?
2) Would I be able to return to the UK with the baby after they are born? If yes, would I need to do some sort of application for the baby?

I hope you find both questions connected to each other and they do not confuse you. Thanks!

If the baby is born in the UK, either before or after you obtain naturalisation, then baby would be British either way, at no extra cost. If born outside the UK baby will need to be registered (Form MN1) for which the fee is just over £1000. Your choice of course.
2) Would I be able to return to the UK with the baby after they are born? If yes, would I need to do some sort of application for the baby?
Likely needs a visa if non-British. If British apply for a passport.

1. You can't register the child as British if the child is born abroad before the parent becomes British. The child will need a visa and follow the same path as the mother and require ilr when the mother applies before the child can be registered as British. A child born abroad to an ilr holding parent has no right to register as British and will follow the same Immigration path as the less privileged immigration status parent.
