Settle Scheme Family Permit for spouse of Polish/British dual citizen

Hello I am the spouse Costa Rican of my family member dual polish/relevant british and we are outside the UK , we want to apply for the settlement scheme family permit and we want to know is if the correct way is through the online platform and giving biometrics in Poland (place where we gonna make the appointment )

Basically I want to know if that is the correct process because reading in some forums says that I need to apply by paper in the lounes case .


I want to confirm that the process is :

1-Apply online for the Settlement Scheme family permit and upload the documents

2-Give biometrics in Poland

3- wait for the decision.


4 if the decision is positive move to UK and start the application through paper of the pre settle status

5- wait for the decision .

Or is not necessary to apply for the family permit and apply right away in the Uk for the settlement scheme ?

All detailed information with steps would be appreciate it thanks !

You need to specify how and when your spouse got British citizenship, as well as for how long you have been out of the UK. Ideally with a detailed timeline. Without this information no one can advise you on the best route that applies to your case.

Hi got the British citizenship 2018 after living studying and working as EEA so she qualified as relevant family member

We are out of the uk since March this year I was there with my tourist visa so now we want to know if it’s better to apply for the SS family permit online first get the Coa and be able to work and then the settlement scheme through lounes

I'm assuming this means your spouse stayed in the UK for 5 years as a qualified EEA citizen (Polish), got permanent residence, and then after that got British nationality. Bottom line is, you need to make sure they did not lose their status as a qualified person, or that they acquired permanent residence before becoming British Citizen (most of cases, but doesn't hurt to double check). If so, you likely qualify for the Lounes paper application route.

You are likely not eligible to apply though Surinder Singh if you are in Poland and want to try to apply on the basis of center of your life in Poland, since that's their home country. Surinder Singh implies the center of one life's is in a EU country other than own's nationality.

You should be consistent. If you apply for the family permit through Surinder Sing, then also apply for Pre-Settlement through Surinder Singh. Same with Lounes.

I was meaning

1-apply settlement scheme family permit through lounges online

2- apply settlement scheme lounes with paper application

And yeap she is qualified so far now we are in Costa Rica and next month in Poland
