Temporary Seperation during application of ILR

Post by ANNA4965 » Mon Aug 17, 2020 6:34 am

Hello,
I'm under a lot of stress with my ILR application at the moment as myself and my husband are living apart for one and a half years now as he wanted to be closer to his workplace and university. He was facing a lot of pressure from his work and we both thought it would he good for him to stay in a rented flat closer to his workplace.
I live in my father's property and we have a daughter together who lives with me. My husband used to live with us as well but the transport is not feasible workplace. I have mentioned all this in my application and I've also given evidence of ongoing communication between ourselves even though living apart. He has plans to move back in with us when my daughter will go to school in September 2020 and be there for both of us. I have explained my situation in the cover letter and within the online form. Please could someone throw some light on this as I have shown reason of living apart.
I'm on a 5 year partner route from spouse visa and my visa is due to expire on 25th August 2020. Please if someone could throw some light on this as its urgent and under a lot of stress.

UKVI will expect you to be in a subsisting relationship and you must provide cohabitation documents. If you live apart for other reasons, the cover letter is enough. It is up to UKVI to evaluate the genuineness of a relationship given the circumstances/evidence

Hi thank you for our response.
I do not have any cohabit documents after august 2018 when he moved out to is flat. However, i do have cohabit documents before he moved out in August 2018. I have some text messages as evidence of ongoing communication and also mentioned that I see him every week when he comes to see me and his daughter and also that he takes our daughter with him for the weekend. There is no legal separation here. we share all our financial duties towards our daughter. He may move back in in September 2020 when my daughter starts to go to school. I have explained all this in the cover letter and I have explained in detail.
Please kindly let me know wether documents before he moved out would be relevant here because i dont have any cohabit documents since after he moved out..just some loan letters and other bits and pieces of letter items.

That won't meet the criteria where 2 years of cohabitation backed with evidence is required for success.
