In an awkward position re: the residency requirement. Advice needed.

Post by throwaway111 » Fri Aug 21, 2020 7:15 pm

Hello, all. Thank you very much for your time.

I sought asylum in the UK as a child in the spring of 2010, secured limited leave to remain in the summer of 2010, and secured indefinite leave to remain in the autumn of 2015. I have lived in England for the last decade. I have never, at any time, left the country.

In late-January 2020, I resigned from a job I secured after graduating from university & moved back home. Unfortunately, the pandemic scuppered my plans to secure immediate work in my home city. I was unemployed and living with my parents in the six months between January to June, after which I managed to secure full-time employment.

As a consequence of my unemployment & my living with my parents during those six months, I suspect that I am unable to provide substantive evidence of my being in this country during this time. According to the residency requirement for naturalisation, I should not have spent more than 90 days outside the country in the last 12 months. I meet this requirement in theory, but if I am asked to provide evidence of my meeting it, I'm not sure if they evidence I'll have will qualify. I attended six in-person job interviews in England between January and March, and the companies have been kind enough to provide me with letters to this effect.

Can you advise as to whether my suspicions are correct? Does this mean I don't meet the residency requirement? Thanks in advance.

You returned to the country you sought refuge and asylum from??

Did you actively apply for a passport from your home country embassy, the country you sought asylum from?

Do you realise your ilr could be revoked?

Hi. Apologies. I may not have been clear.

I never returned to the country I sought refuge from. I have never left the UK since arriving. When I say I "moved back home", I mean I moved to my parents' home (in the UK) from the apartment I was renting in another city.

I do not have a passport from my home country. I've been using my biometric residence permit as my ID.

If there are gaps in a person’s evidence of residence and it is clear from the information available that they could not have travelled, you must accept this. Examples of this might include a refugee who has no means of travel or where immigration records confirm continuous residence.
