Clock for ILR eligibility

Post by narass » Mon Aug 24, 2020 11:58 pm

Hi, my wife history of uk visas is as follows
1. tier2 ict from 2010nov to sep 2019,
2. Tier ict dependant - sep2019 to sep2020
3. Now she has to submit application as ilr dependant

1&2- done within uk.
Query : if she submits the application for point3 from outside uk , will it be considered as a break ie will her clock reset ?

Presumably you are asking about clock reset for ilr based on 10 years long residnece??

Her 5 year ilr clock resets anyway regardless if where she applies.

She can apply from abroad for a spouse settlement visa, but they can take many months to be approved.

It is easier and usually quicker to apply for a spouse visa within the UK.

For long residence, she must return with a new visa within 180 days from the date she left the UK to not break her continuity of residence, assuming she hasnt6 broken it previously.
