one of our children is temporary outside of UK.Can we naturalise them both?

Post by Youngeagle » Sun Aug 23, 2020 2:33 pm

Hello everyone,

We have 2 children and would like to naturalise them both as British Citizens
One of them is abroad temporary for several months to visit relatives but both have British Birth Certificates and both born in UK.
Is it possible to Naturalise them both? It says all the passports must be originals.
As in application form there is such clause:

You must provide your documents after you submit your application, these can be originals or copies.

Any passports provided must be originals.

You will be able to upload copies of your documents on our commercial partner's website, or you can take your documents to your biometrics appointment to be scanned and uploaded by our commercial partner for a fee. You'll be told how to book an appointment and upload your documents after you submit your application.

You do not need to send any physical documents to the Home Office or UK Visas & Immigration unless you are advised to do so.

My concern is as one of my kids is abroad and would it affect the application?

As on the application itself it says:

You must provide your documents after you submit your application, these can be originals or copies.

Any passports provided must be originals.
And the fact he is abroad?

We are all unpaid volunteers on the forum and all have normal (non immigration) day jobs and other family commitments!!

No!

Originals are NOT submitted anymore. They are scanned and uploaded digitally.

Thanks for your answer.
And do the same rules applied to children as to adults? Do the children have to wait for 1 year after they have been granted permanent residence ? to naturalise ?
Sorry to be pushy

Not for UK born children no.

Children born abroad can only apply when either parent is also applying and the other parent is settled.

Sorry to be a pain

But how are the absences treated? If the child under age of 5 was absent for half year or at least 3 months at the time of making application on the grounds of permanent residence ?

THANKS!!!!!

Because adults have to wait for 1 year after getting permanents residence and then they must have no absences ( certain amount of days they can't be absent )
The same rules are not applicable to children who want to naturalise ? UK born children

Both U.K. born children are entitled to register, irrespective of location, etc.

Really grateful for all the answers.

But as my son is away, what should I do with passport ?

AS ON THE NATURALISATION FORM IT CLERLY SAYS

ALL THE PASSPORTS MUST BE ORIGINALS. He is abroad. Do i Have to send the passport to UK via DHL or another courier and then send it back for him to get to UK?

Thanks

So other words to say we can not apply for Naturalisation for my son?

We should take into account any evidence already on the file. If documents have been seen and noted in the past there is no need to ask to see them again

The passport is not on the file. However he received the permanent residence ( applied online and granted on the basis of mothers permanent residence)

But they need the ID?

Thanks

See also Evidence required under section 1(3).
Please take the time to read! Is there a child’s passport requirement?

I am confused I called them and they said NO ( over the telephone )
They said in digital format ( applying online ) you don't have to send one but on the form itself there is requirement.

that what it says on the form

Evidence to be supplied
To guard against the possibility of fraud, we would expect to see the evidence of identity over and above that required to establish an entitlement to registration. You must not accept a birth certificate as evidence of identity. A birth certificate is evidence of an event not the individual’s identity.
We should take into account any evidence already on the file. If documents have been seen and noted in the past there is no need to ask to see them again. If the parents’ marriage or a parent and child relationship has been accepted as valid by an entry clearance officer, immigration officer, Home Office official or any tribunal or court in the UK, there is no need to ask for further evidence unless there is a reason to doubt the previous decision. For example, in some situations a subsisting relationship is accepted for immigration purposes but for nationality purposes a valid marriage is needed.

They said in digital format ( applying online ) you don't have to send one but on the form itself there is requirement.
Note you are expected to apply online from within the UK and all documents required are scanned / uploaded - that is no originals to be sent.
The paper form is for applications made from outside the UK.
This is just my opinion as a member of this forum and does not constitute immigration advice.

How is a child born in the UK able to be outside the UK without a passport?
Or are you trying to make an online application as if he was in the UK?
What about biometrics?

How is a child born in the UK able to be outside the UK without a passport? ---- He is outside the UK with his passport and he will come to do biometrics.

Or are you trying to make an online application as if he was in the UK? yes we pretend that we are in the UK

What about biometrics? I planned once the naturalisation has been approved.

BUT THE PROBLEM IS- We would like to apply without passport? Or with copy of passport?

Do you think it will work?
