ILR dependent applying for extension

Hi there,

I have a query related to dependents visa extension. I am holding Tier 2 (ICT). My timeline is as follows.

Entered UK in May -2010
Visa expires in Dec -2020

I have applied for ILR via 10 year route SET (LR). My depends visa due to expire on Dec-2020 and they have completed only 8 years of continuous stay in UK

My questions:
1. Can I apply for dependents visa extension while my ILR application is in process
2. Do I need to apply dependents extension as a tier 2 extension or as a ILR dependents.They will
be eligible for ILR after 2 years
3. Will you be able to provide a link for dependents visa extension

Any guidance would be really helpful

You cannot apply for a Tier 2 ICT Dependent visa extension. Your spouse has to apply for FLR(M) spouse visa and meet the English A1 and financial requirements of £18,600pa (more depending on how may children you have).
2. Do I need to apply dependents extension as a tier 2 extension or as a ILR dependents.They will
be eligible for ILR after 2 years
FLR(M) spouse/child visas. They don't qualify for tier 2 dependent extensions. All visas count for ILR long residence. Each person applying must meet the requirements for ILR based on long residence and complete individual application forms.

Out of curiosity, As I have been extending my dependents visa as PBS dependent for the last 8 years,is there any reason that I can't follow the same route now ??

The rules don't allow it if you apply for ilr based on 10 years long residence. This has been in place since April 2014, so isn't anything new.

Hi - As I am still waiting for my ILR decision, I have a dilemma about dependents extension

1. Would it be advisable to hold dependents application submission for extension until I get a decision or should I submit now ??
2. Submitting dependents application without getting decision on main applicant will have any impact ??

I am conscious about increased health service charge from 1st Oct. Dependents visa due to expire by mid Dec-20

Appreciate your guidance on this

You must apply before their visas expire, regardless of how long your application takes. If you apply now, their application will be held anyway as they don't qualify for FLR(M) until your ILR is granted. If your ILR fails, their FLR(M) will also fail.
2. Submitting dependents application without getting decision on main applicant will have any impact ??
There application will not be processed until your ILR is granted as they don't qualify for FLR(M) visa if you do not have ILR.
