Tier 2 General Visa: CoS withdrawn before receiving replacement visa

Post by redsparrow007 » Sat Sep 12, 2020 7:04 am

Hi there. I hope someone could help me understand my situation.

I have applied for a Tier 2 General visa and I have received the visa,
which is valid for 3 years; unfortunately, it got expired due to travel
restrictions. Then my employer send me an email that they have withdrawn
CoS.
After that UK immigration office asked me to resubmit my passport for
replacement visa and received 90 days valid vignette visa with same CoS
number.

To sum it up, I got the visa on my passport with same withdrawn CoS number
and I haven't even entered the UK yet.

My question is: Can I still use my visa in order to travel to the UK and
maybe look for a new job or sponsor within a certain period of time?

Is there any curtailment of visas and the wrap-up period but does this
apply in my case, knowing that I haven't actually traveled to the UK due to
covid situation ? Is there any relaxation of rules regarding this due to
Covid?

Many thanks.

Post by redsparrow007 » Sat Sep 12, 2020 7:13 am

Hi there. Please help me

I have applied for a Tier 2 General visa and I have received the visa, which is valid for 3 years. Due to travel restriction I have asked to resubmit my passport for replacement visa. Then my sponsor send me an email saying that they have withdrawn my CoS. But I have received replacement visa with same CoS number. What I need to do now ? Is this means CoS is still valid? Can I travel using this visa and look for another sponsor within any time limit?

Please someone help me I am totally confused..

Urgent Please help: Replacement visa validity

Post by redsparrow007 » Sat Sep 12, 2020 7:27 am

Hi, Please help me it’s very urgent.

I received 3 year valid Uk Tier 2 General Visa on May. But due to travel restrictions I couldn’t travel and Uk immigration office asked me to resubmit my passport for replacement visa and I did. Then my employer send me an email saying that they have withdrawn my restricted CoS and can’t employ me anymore.
After that I have got replacement visa with same CoS number. Does this mean I can still travel on this visa look for another job within any time limit?

I tried all ways to find an answer but none responding.
Please someone understand my situation and help me :(

Many Thanks,

Please do not spam the forum with multiple topics asking the same thing!!!

If your cos is withdrawn, your visa will likely be cancelled or curtailed. You might be notified, you might not as you are not in the UK.

If you attempt to travel to the UK, you could be refused entry and returned to your home country as your basis of stay is no longer valid. The IO at the airport will see the full details on their system.

Apologies, i thought experts are answering based on keywords. Will remove my other two posts.

Thank you very much for your response. :)

So basically this replacement visa is invalid and I have to apply for new Tier 2 visa for new employer from my current country. Is that correct?

Many Thanks,

The replacement visa vignette is just that, a replacement for one you had that expired. You cannot work at all, for anyone, in the UK on the visa you have if your sponsor has withdrawn the cos and their offer.

At risk of being refused entry to the UK, yes that would be the safest option.

Bear in mind that many people in the UK are losing their jobs, including tier 2 migrants already in the uk, and you might not find the abundance of jobs or sponsors willing to sponsor you anymore in the current climate.
