ILR for Spouse - Time period

Post by newszb » Mon Sep 14, 2020 7:09 pm

Hi,

I just Received my citizenship approval, applied on 9th May2020 via ILR 10 + 1 year, Face ID/ on IDV app on 26 Aug 20.

Thanks to @CULLINAN.

I have a quick question, my wife is on 1st FLR-M Visa, expiring next year, i assume she needs to extend one more time.

But when can she apply for ILR ?, once i received Citizenship certificate her status remains same or can she apply earlier ?

Thank you very much

Yes, she needs an extension.
But when can she apply for ILR ?,
When she has 5 years on a spouse visa, ie 2 X 2.5 year visas.
once i received Citizenship certificate her status remains same or can she apply earlier ?
She remains on the same visa route. No she cannot apply earlier, you becoming British is irrelevant to her requiring the mandatory 5 years residence.

She has to stay on the same FLR(M) visa for 60 months. She can apply for ILR when she completes 60 months minus 28 days from the first date of entry in UK.
She should apply for extension up to 28 days before current visa expiry so her 60 months are completed and there is no shortfall for ILR.

She will stay on the same visa even after your citizenship.
