ILR SET (O) Dependent Visa Extension

Hello All,

I am applying for ILR SET(O) on 14th August with a child dependent but my husband will complete 5 years in Feb 2021. His Tier 2 (General) dependent will expire on 10th Oct 2020.

M<y question is can I apply for his visa extension now? If yes how much health surcharge I have to pay(a full year I assume).

You can apply anytime before visa expiry. Visa extension is a 3 year visa, IHS is £400 per year (£1200 in total)

The child will not qualify for ILR with you if your husband is not applying. The immigration rules don't permit this. The child must apply for ILR when your husband does.

Note that the IHS fee is increasing in October from £400 per year to £625 per year.

Even if child was born in the UK (Nov 2019)?

A child born in the UK doesn't require ILR either (or a valid visa) if you plan on registering the child as British.

If we switch his visa from Tier 2 (Dependant) to ILR (Dependant) that will cost us less?

Not really as the visa fees are more at £1033 for ILR dependent plus £1000 IHS and also his ILR clock will also reset to zero and a new 5 year route before he can apply for ILR.

The child doesn't need a visa, you can register the child as British once either parent has ilr. How many more times do we need to tell you this.
