I made a stupid mistake and applied my wife ILR 1 day late. Her visa (FLR-M) was expired on August 15th, 2020 and I submitted and paid on August 16th, 2020 via online form. I had it in my mind that its expiring on 18th dont know how it happened.
Could anyone tell me what will be the outcome of this stupid mistake? Will homeoffice consider this application and if not than what options I have?
Yes you are right and hope caseworker overlook it. If not what are the options? Any ideaseagul wrote: ↑Thu Oct 01, 2020 9:30 pmCYBER2150 wrote: ↑Thu Oct 01, 2020 9:22 pmHi

A visa holder should always keep memorized his/her date of visa expiry, and the same should also keep parroting by other family members too, because most often no discretion is offered. Hope the caseworker overlook it.
Many times the caseworker offer flrfp under 10 years of route with a new ILR clock. In the meanwhile, try to find any maintenance work if miraculously was announced somewhere on their website for 15th Aug as a loopholeCYBER2150 wrote: ↑Thu Oct 01, 2020 9:34 pmYes you are right and hope caseworker overlook it. Her application will be considered under paragraph 39E and if she was eligible for ILR on that day, she will be granted ILR.CYBER2150 wrote: ↑Thu Oct 01, 2020 9:22 pmHi

For now, her application is considered out-of-time, she became an overstayer and she has lost her right to work until ILR is decided.
There will be no future adverse immigration consequences if there has been a short break of continuous residence if your leave expired between 1 March 2020 and 31 August 2020. However, if you did not make a valid application to stay by 31 August 2020, you must now make arrangements to leave the UK.
