Tier 2 General to ILR questions

Post by melech » Sun Oct 11, 2020 11:34 pm

Help – ILR apply date

I am not quite sure when I qualify to apply for ILR via 5 year Tier 2 route or if I actually qualify before my current visa runs out

02/02/2012 – Tier 2 granted and was due to expire on 25/01/2018
10/03/2016 - Sponsor’s license expires, curtailment consideration raised
13/05/2016 - Leave curtailed
17/07/2016. – Curtailed leave to end
16/07/2016 – In time application for ILR on compassionate grounds, this was refused on 05/07/2018
31/07/2018 – Application for Tier 2, this was successful and is due to expire 02/02/2021

Could somebody please help me work out when I can apply for ILR?

There were no appeal rights for PBS migrants at this time. Only AR option.

Yes, I put in an appeal.

The refusal letter I was sent mentioned that I had a right to appeal and so I appealed.

Sure but ILR applications on the grounds of human rights lead to appeal rights that is why I asked.

When did you withdraw the appeal?

You have been eligible since your last Tier 2 was granted. I suggest making an SAR request to ensure that UKVI is on the same page

Thank you for your response.

I am not quite sure what you mean by SAR request or how to make one.

Any guidance? Please.

I am so sorry

It would appear I made a silly typo when outlining the dates initially - only the date of the 1st Tier 2 was wrong though

19/12/2014– Tier 2 granted and was due to expire on 25/01/2018
10/03/2016 - Sponsor’s license expires, curtailment consideration raised
13/05/2016 - Leave curtailed
17/07/2016. – Curtailed leave to end
16/07/2016 – In time application for ILR on compassionate grounds, this was refused on 05/07/2018

Could this then mean I already qualify for ILR, or not?

Do I still send the SAR request?

SAR shows the details of your immigration history. Without it we have to assume your claims and what UKVI has on your file in fact match. SAR is needed for an accurate picture
